TERMS AND CONDITIONS

1. Application for Service Each prospective Customer desiring electric service from the Merrimac Municipal Light Department (MMLD) shall be required to submit an Application for Electric Service at MMLD’s business office at 10 West Main Street Merrimac, MA 01860 between the hours of 7:30 a.m. and 4:00 p.m., Monday through Friday, excluding holidays, or online at www.merrimaclight.com. Service will not be offered until all necessary information has been received from the applicant. Applications for electric service or change of service must be submitted at least seventy-two hours (3 days) prior to the effective date of the service or change of service.2. Account Deposits Existing Accounts: Existing residential accounts may be required to establish or maintain a security deposit based upon the following criteria:1. if two payments are rejected by HMLP’s bank within a twelve (12) month period; or2. if the account remains unpaid after 45 days from the date of bill;3. if service is terminated for non-payment of electric charges; or4. if customer moves to another address and payment history for previous account does not show a zero balance or fits any of the other criteria listed above.MMLD may require a cash deposit equal to an estimated bill for up to three months’ service for security for payment of the Customer’s indebtedness. Interest will be paid by MMLD upon any such cash deposit if such deposit is held for more than six months in accordance with the Massachusetts General Laws3. Billing and Payment All bills shall be due and payable upon presentation. Bills will be rendered monthly and may be paid at MMLD’s  business office, online at www.merrimaclight.com  Failure to receive the bill will not release the Customer from payment obligation. The due date for payment of the bill for all classes of Customers will be 25 days from the date of the bill. If not paid within 45 days of receipt, service shall be subject to termination in accordance with the Department of Public Utilities billing and termination regulations and the Massachusetts General Laws. After any such discontinuation of service, the Customer will pay an initial reconnection charge of $50, $150 for a second reconnection charge and $200 for any subsequent reconnection charges during office hours. Each such reconnection charge after hours (including nights, weekends, and holidays) will be increased by $25, plus payment of all arrears, before service will be restored. Payment plans will be available upon request.Checks returned as non‐sufficient funds are subject to a $25 MMLD processing fee.All meters shall be read at least every other month per the Department of Public Utilities’ billing and termination regulations, and bills shall be rendered monthly except in cases where access to the meter is not obtained on the regular reading date, or where for other reasons MMLD rules a different billing period is required or desired.4. Point of Delivery The Point of delivery is the point, as designated by MMLD, on the Customer’s premises where the current is to be delivered to the building or premises. All wiring and equipment beyond this point of delivery shall be provided and maintained by the Customer at no expense to MMLD.5. Interruption of Service MMLD shall not be irresponsible for any interruption, abnormal voltage, discontinuance or reversal of its service, or failure to supply electricity, due to causes beyond its immediate control including weather, accident, labor difficulties, condition of fuel supply, actions of any public authority, or failure to receive any electricity for which in any manner contracted, or due to the operation in accordance with good utility practice of an emergency load reduction program by MMLD or one with whom it has contracted for a supply of electricity, or inability for any other reason to maintain uninterrupted and continuous service.6. Damage to Customer Property MMLD shall not be liable for damage to the person or property of the Customer or any other persons resulting from the use of electricity or the presence of MMLD’s appliances and equipment on the Customer’s premises unless such damage is due to MMLD’s gross negligence or willful misconduct. Neither by inspection nor non-rejection nor in any other way does MMLD give any warranty, expressed or implied as to the adequacy, safety or other characteristics of any equipment, wiring or devices, installed on the Customer’s premises. MMLD shall not be liable for damages resulting in any way from the supplying or use of electricity or from the presence or operation of the Company’s service, conductors, appurtenances or other equipment on the customer’s premises.7. Metering For the purpose of determining the amount of electricity delivered, a meter or meters shall be installed by MMLD at a location to be designated by MMLD on meter sockets or troughs, provided by and wired by the Customer. Upon the reading of the Customer’s meter, all bills shall be computed. If more than one meter is installed, except for the convenience of MMLD, the applicable rate charges shall be made for each additional meter.The Customer shall furnish and install upon its premises such service and meter switch or circuit breakers as shall conform with specifications issued from time to time by MMLD, and MMLD may seal such circuit breaker, and such seals shall not be broken and that such adjustments or setting shall not be changed or in any way interfered with by the Customers. Cutting the meter seal without prior approval of MMLD may result in the assessment of a $100 service fee.8. Customer Responsibilities The Customer shall furnish upon its premises, at no cost to MMLD, the necessary space, housing, fencing and foundations for equipment required in connection with the supply of electricity whether the equipment is furnished by the Customer or MMLD. Such space, housing, fencing and foundations shall be in conformity with MMLD’s specifications and subject to its approval.The Customer’s wiring, piping, apparatus and equipment shall, at all times, conform to the requirements of the National Electrical Safety Code and to those of MMLD, and the Customer shall keep such wiring, piping, apparatus and equipment in proper repair. By establishing service to the Customer, MMLD makes no warranty or representation of any kind that the Customer's facilities and wiring conform to any such requirements, standards, or the National Electrical Code.9. Access Permission is given MMLD to access the Customer’s premises at all reasonable times for the purpose of installing, inspecting, repairing or removing MMLD’s meters and other appliances or equipment owned by MMLD.Employees of MMLD will not diagnose problems nor repair customer-owned equipment such as but not limited to light bulbs, fuses, circuits, or switches.The Customer shall not permit access for any purpose whatsoever, except by authorized employees of MMLD, to the meter or other appliances and equipment of MMLD, or interfere with the same, and shall provide for their safekeeping. In case of loss or damage of MMLD’s property, the Customer shall pay to MMLD the value of such property or the cost of repairs.The Customer is responsible for the installation, maintenance and repair of all components of the electric service, except the meter, up to and including the point-of-attachment. On an overhead service, the point-of-attachment is the support bracket, installed on the customer’s structure, on which MMLD’s service drop will terminate. On an underground service, the point-of-attachment is the MMLD-owned manhole/ handhole designated by MMLD staff on or near the property line. On underground services originating at a MMLD owned pole, the point-of-attachment will be at MMLD’s secondary conductors.10. Repairs Temporary Repairs to a Permanent Service: In instances where Customer-owned equipment fails in service, MMLD will make a reasonable effort to temporarily repair/replace the faulty equipment to ensure the customer has electrical power until permanent repairs can be made. If repairs are not made within five (5) days, MMLD will discontinue service until repairs are made to the satisfaction of the Town of Merrimac’s Electrical Wire Inspector. In the case of an underground service cable failure, the customer will have thirty (30) days to retain a licensed electrician and have the defective cable replaced/repaired. At the end of this 30-day period, MMLD will disconnect and remove the temporary service.11. Temporary Service Connections Temporary service connections for new building construction, outdoor lighting, fairs, carnivals, and other short-term purposes will be made upon payment in advance of a minimum charge of $100 per service, such payment will be in addition to any subsequent payments for electricity. Where a temporary transformer installation is necessary the Customer shall pay the full cost of the installation. The Customer shall provide and erect the necessary structure and install a suitable grounded switch and meter socket as shall conform to MMLD’s specifications. The Customer will be held responsible for damages to MMLD’s meter and equipment while in Customer’s possession and shall notify MMLD in advance of termination of this service.12. Extensions MMLD may require a Customer to pay the whole or a part of the cost of extending its lines to a Customer’s premises or other reasonable payments in addition to the payments for electricity whenever the estimated expenditures for the equipment necessary to properly supply the Customer’s premises shall be of such an amount that the income to be derived there from at the applicable rates will, in the opinion of MMLD, be insufficient to warrant such expenditures. Customer must consult with MMLD’s General Manager regarding fees and technical requirements before the installation of any overhead or underground extensions.13.  Dig SafeState laws require anyone who digs to notify utility companies before starting as digging can be dangerous and costly without knowing where underground facilities are located. Before any excavation begins, call Dig Safe at 888-DIG-SAFE to obtain information about the existing underground facilities in any specific area.14. Notice of Trouble The Customer shall notify MMLD immediately should the service be unsatisfactory for any reason, or should there be any defects, trouble, or accidents affecting the supply of electricity. Such notices, if verbal, should be confirmed in writing.15. Standby and Resale Service All purchased services (other than emergency or standby electric service) used on the premises of the Customer shall be supplied exclusively by MMLD, and the Customer shall not, directly or indirectly, sell, sublet, assign, or otherwise dispose of the services or any part thereof. The following general requirements apply to Customer generating facilities designed to operate directly connected to MMLD’s electrical system (parallel operation) and those which are designed to operate isolated from MMLD’s system (non-parallel operation). Requirements and specifications for various types and sizes of Customer facilities shall be obtained from the MMLD prior to installation.Standby generation (non-parallel operation) may be installed by the Customer to supply all or part of the load in the event of a service interruption. The Customer’s wiring shall be arranged so as to prohibit the interconnection of the MMLD’s service and the Customer’s alternative source of supply. This will require the installation of a double throw, break before make, switch or its equivalent as approved by MMLD.NOTE: Precautions must be taken where alternative means of generation are employed, whether emergency or otherwise, to eliminate the possibility of electrical connections between MMLD’s service and the Customer’s alternate source of supply (e.g., truck docks, etc.). The Customer must notify MMLD and provide electrical details of the generator installation and isolation from MMLD’s system.Standby generation (parallel operation) requires notification of MMLD before installation begins. Prior to the installation of any auxiliary generator facilities (e.g., wind turbine, solar panels, etc.), the Customer must notify MMLD to provide interconnection details and to obtain approval for the facility’s protective and synchronizing equipment arrangements.16. Discontinuance of Service MMLD shall have the right to discontinue its service where the Customer fails to comply with or perform any of the requirements or obligations of these Terms and Conditions or any other agreement with MMLD, or if the equipment and apparatus of the Customer interferes unduly with service to other Customers of MMLD. For restoration of service after such discontinuance, a reconnection charge of $50 during office hours and $75 after hours (including nights, weekends, and holidays) will be made. After any such discontinuation of service, the Customer will pay an initial reconnection charge of $50, $150 for a second reconnection charge and $200 for any subsequent reconnection charges during office hours.When a tenant moves out of a rental unit, the service will automatically revert back to the property owner, unless the property owner submits to MMLD a signed letter indicating that the owner does not want temporary electric service for the rental property.17. Unauthorized Use Whenever MMLD determines unauthorized use of electricity by a customer, MMLD may make such changes in its meters or other equipment on said Customer premises or take such other corrective action as may be appropriate to ensure the safety and security of the general public, the equipment and its installation under the circumstances. MMLD shall have the right, when an unauthorized use of electricity has occurred, to assess reasonable estimated electric demand, if applicable, and energy charges back to the beginning of the unauthorized use, as well as all costs incurred in correcting the condition. MMLD may require full payment of all charges and costs prior to reenergizing. Nothing in this paragraph shall be deemed to constitute a waiver of any other rights of redress which may be available to MMLD or to limit in any way any legal recourse which may be open to MMLD under the Massachusetts General Laws regarding unmetered service and meter tampering.18. Applicability These Terms and Conditions for Electric Service are a part of all contracts for receiving electric service from MMLD, whether the service is based upon contractual agreement, signed application, or otherwise. A copy of MMLD’s Schedule of Rates is available online at <a href="https://merrimaclight.com/rates/" target="_blank" rel="noopener">merrimaclight.com</a>These Terms and Conditions may be revised, amended, supplemented, or otherwise changed from time to time by MMLD. Such changes, when effective, shall have the same force as the present Terms and ConditionEffective November 1, 2024.

IT IS EXPRESSLY UNDERSTOOD AND AGREED TO THAT THE APPLICATION IS NOT A CUSTOMER OF RECORD UNTIL (1) THIS APPLICATION IS COMPLETED AND ACCEPTED (2) ALL REQUIREMENTS OF THE RULES, REGULATIONS AND RATES OF THE DEPARTMENT HAVE BEEN COMPLIED WITH AND (3) ANY REQUIRED DEPOSIT HAS BEEN PAID IN FULL. FAILURE TO COMPLY WITH THESE CONDITIONS WILL RESULT IN IMMEDIATE TERMINATION OF SERVICE. THE UNDERSIGNED AGREES THAT THE APPLICANT WILL PROVIDE AT LEAST 10 DAYS NOTICE OF ANY INTENTION TO CLOSE THE ACCOUNT OR TERMINATE SERVICE AND THAT THE APPLICANT IS LIABLE FOR ANY AND ALL CHARGES FOR SERVICE UNTIL SUCH TIME AS THE DEPARTMENT OBTAINS ACTUAL METER READINGS TO CLOSE THE ACCOUNT. THE UNDERSIGNED MAKES APPLICATION FOR UTILITY SERVICE AT THE PREMISES LOCATED AS DESCRIBED ABOVE. IT IS EXPRESSLY UNDERSTOOD THAT SUCH SERVICE WILL BE PROVIDED IN ACCORDANCE WITH THE PUBLISHED RULES AND REGULATIONS NOW IN EFFECT OR FROM TIME TO TIME AMENDED.
