Legal Notice
Pursuant to G.L. c. 30B, § 16, the Merrimac Municipal Light Department (“MMLD”) seeks sealed proposals for the purchase and sale of real property located at 10 West Main Street, Merrimac, MA (“Property”).
The Property is being sold subject to the following restriction:
The development and reuse of the property shall comply with all use and dimensional requirements of the Town of Merrimac, without waiver, variance, comprehensive permit pursuant to M.G.L. c. 40B, or other relief, and further, the construction of multi-family housing shall not be permitted.
The restriction shall run with the land and shall bind the grantee and all successors and assigns and shall be perpetual or continue for the longest period permitted by law.
The property is offered “as is, where is,” with no representations or warranties made by MMLD regarding the condition of the property, zoning compliance, environmental status, suitability for development, or fitness for any intended use. Interested parties are solely responsible for conducting their own due diligence.
The Property is available for visual inspection on July 8, 2026 from 8 a.m. to 3:00 p.m. or by appointment by contacting Mary Usovicz at 978-346-8311.
Interested parties shall submit sealed proposals no later than July 13, 2026 by 3:00 p.m. Late proposals will not
be accepted.
Submit the original and three (3) copies of the proposal in a sealed envelope clearly marked “Property Purchase – 10 West Main Street” and addressed to:

Proposals may be hand delivered, mailed, or sent by courier.
Each proposal shall be accompanied by a deposit in the form of a certified or cashier’s check payable to the Merrimac Municipal Light Department in the amount of $10,000.00.
MMLD will open proposals publicly on July 14, 2026 at 9:00 a.m. at its offices at 10 W Main Street Merrimac, MA.
No proposal may be withdrawn or modified after opening and shall remain firm for 10 business days.
The award is contingent upon the execution of a Purchase and Sale Agreement acceptable to MMLD counsel and Town Counsel.
MMLD reserves the right to reject any and all proposals, waive minor informalities, and accept the proposal deemed to be in the best interest of MMLD.
